When Do Employers Have To Reverify Or Update I-9 Documents?

1 9 Form 2022 – Employers are required to update an employee’s paperwork only when the employee’s employment authorization documentation (EAD) or receipt has expired. Reverification should be done at least one year prior to the date of expiration of the work authorization. If the employer is unable to reverify the work authorization, then the worker’s contract may not continue. Employers who employ temporary work visas are advised to file for an extension no later than 90 days before the expiration date of their EAD. Certain employment eligibility categories could be qualified for automatic extensions to their expired EADs when they submit in time EAD renewal applications.

Employers may complete Section 3 of the original Form I-9, if the original is the current version of the form. If the original Form I-9 is older, the employer has to complete Section 3 or complete a completely new I-9 on the current version. The employer must add the new Form I-9 with the original.

An employee who gave a receipt for any document while filling out the I-9 initial form has 90 days to present their employer with the replacement document. Employers are required to use Section 3 of the current Form I-9 to alter the details or draw an outline of the information that was previously provided to ensure it is legible. After the line has been drawn, insert the new information and sign and ink the change. If, within the 90-day timeframe, the employee wants to present a different acceptable document, which differs from the receipt document was issued for then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of clarification either in the additional information box found on page 2 of the Form I-9 or as a separate attachment.

I-9 forms with green cards that are no longer valid then should not be reissued. Green cards signify permanent residence in the United States, and they expire in the same manner as driver’s licenses do. The expiration date doesn’t necessarily mean that the owner is no longer authorized to work in the U.S.

Employers may also amend Section 3 of the Form I-9 when an employee’s name is changed. But, it’s not required.
