1-9 Form 2022 – Form I-9, officially the Employment Eligibility Verification, is an United States Citizenship and Immigration Services form. Mandated by the Immigration Reform and Control Act in 1986, it’s used to verify the legal identity and authorization to work of all employees who are paid in the United States. Are Employers Legally Required To Reverify Or Update I-9 Documents?

1-9 Form 2022 – Employers are required to reverify the employee’s documents only after the employee’s employment authorization certificate (EAD) or the receipt is expired. Revisions must be made before the expiration date of the work authorization. If the employer isn’t able to update the work authorization, the worker’s work authorization will not be extended. Temporary workers with work visas are advised to file for an extension no later than 90 days before the expiration date of their EAD. Certain categories of employment eligibility that make on time EAD renewal applications could be granted automatic extensions of their expired EADs.

If the form originally used is current employers may complete the Section 3 of the original I-9. If the original version is an earlier version of the Form I-9 employers must either fill in Section 3 on the current version of the I-9 or complete a new I-9 entirely with the current version. In either situation the employer has to attach the new Form I-9 to the previous one.

An employee who gave an acknowledgment of a document when completing the I-9 initial form will have 90 days to provide the employer with a replacement document. The employer should make use of Section 3 on the current version of the Form I-9 to update the information or draw a line along the old information (so that it is still accessible) and then add the new information, and then initial the change. If, within the 90-day window, the employee decides to submit another acceptable document that differs from the receipt document was issued for and the employer is required to complete Section 2 on a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the box for additional information included on page 2 of the Form I-9 or as a separate attachment.
