2022 Form I-9 – Form I-9, also known as the Employment Eligibility Verification, is a United States Citizenship and Immigration Services form. Are Employers Legally Required To Reverify Or Update I-9 Documents?

2022 Form I-9 – Employers are required to update the employee’s documents only after the employee’s employment authorization form (EAD) or receipt is expired. Reverification should occur before the date of expiration of the authorization. If the employer isn’t able to amend the work authorization, then the worker’s job may end. Temporary visa holders are advised to request extensions no later than 90 days before expiration of their EAD. Certain eligibility categories for employment who submit on time EAD renewal applications may receive automatic extensions to their expiring EADs.

If the form originally used is current employers are able to fill out Section 3 of the I-9 originally issued. If the original form is a prior version of Form I-9, the employer should either fill in Section 3 on the current version of the I-9 or fill out a fresh I-9 completely with the current version. Employers should be sure to attach the latest Form I-9 to the original.

An employee who gave an acknowledgment of an item when filling out the I-9 initial form has up to 90 days to present his employer with the replacement document. Employers may also choose to amend the Form I-9 under Section 3 whenever an employee is affected by an identity change, but there isn’t a requirement to do so.
