2022 I 9 Form – Form I-9, also referred to as Employment Eligibility Verification is a United States Citizenship and Immigration Services document. Mandated by the Immigration Reform and Control Act of 1986, it’s used to verify the legal identity and authorization to work of all employees paid in the United States. When Are Employers Required To Revise Or Update I-9 Documents?
2022 I 9 Form – Employers are required to reverify an employee’s documentation only when the employee’s employment authorization certificate (EAD) or receipt is expired. The reverification process must be completed prior to the expiration date of the work authorization. Employees could be fired if their employer fails to update the authorization. Temporary work visa holders are advised to apply for an extension at least 90 days prior to the expiration of their EAD. Certain employment eligibility categories could be eligible for automatic extensions of expired EADs by submitting timely EAD renewal requests.
Employers may complete the Section 3 of the original Form I-9 if it’s the latest version of the form. If the original Form I-9 is older, the employer has to complete Section 3 or complete a completely new I-9 for the most current version. Employers must join the updated Form I-9 to the original.
If an employee gave the document in a receipt at the time of completing the I-9 then he or she is given 90 days to provide an employer the replacement document. When that happens, the employer should use Section 3 on the current version of the form to correct the information or draw a line through the previous information (so that it remains legible), insert the new information, then sign and acknowledge the modification. If, during the 90-day timeframe, the employee chooses to present another acceptable document that is different from the document the receipt was issued, the employer should complete Section 2 on a brand new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the box for additional information that is located on page 2 of the Form I-9 or as a separate attachment.
I-9 forms with green cards that have expired since then should not be reissued. Green cards are permanent residence permit, which can be used in the United States. They expire as driver’s licences do. However, the date they expire doesn’t mean that the owner has lost their authority to work in the United States.
Employers may also amend Section 3 of the Form I-9 in the event that an employee’s name changes. But, it’s not required.
