What Is The Deadline For Employers To Revise And Amend I-9 Documents
2022 I-9 Form PDF – Employers are required to reverify an employee’s documentation only when the employee’s employment authorization document (EAD) or receipt has expired. Reverification should be done before the date of expiration for the work authorization. If the employer is not able to update the work authorization, the worker’s job may not continue. Employers who employ temporary work permits are encouraged to file for an extension at least 90 days prior to the date they expire on their EAD. Certain categories of employment eligibility that submit early EAD renewal applications can be granted automatic extensions to their expiring EADs.
Employers can fill out the Section 3 of the original Form I-9 provided that it’s the latest version of the form. If the original Form I-9 is older, the employer has to fill out Section 3 or complete a completely new I-9 using the latest version. In either scenario the employer must attach the new Form to the original one.
A person who has given an acknowledgement for a document when completing the I-9 initial form is given 90 days to present their employer with a replacement document. Employers should use Section 3 of the current Form I-9 to alter the information or draw an outline through the information that was previously provided to ensure it can be read. After the line is drawn, insert the updated information and then confirm the change by inking it. If, within the 90-day window, the employee wants to present a different acceptable document that differs from the receipt that was issued and the employer is required to complete Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the box for additional information located on the 2nd page of the Form I-9 or as a separate attachment.
I-9 forms with green cards that are expired they were issued, should not be renewed. Green cards indicate permanent residency in the United States, and they expire as driver’s licences do. The date of expiration does not mean that the holder has been unable to work within the U.S.
Employers can also modify Section 3 of Form I-9 if the employee’s name changes. However, it is not required to do this.
