2022 I-9 Form – Form I-9, officially known as Employment Eligibility Verification, is an United States Citizenship and Immigration Services form. Are Employers Legally Required To Update Or Revise Their I-9 Documents?
2022 I-9 Form – Employers are required to update the employee’s documents only after the employee’s employment authorization document (EAD) or receipt has expired. Reverification must be done not later than the expiration date of the authorization to work. If the employer isn’t able to update the work authorization, then the worker’s contract may end. Temporary visa holders are advised to apply for an extension not later than 90 days prior to the expiration date of their EAD. Certain eligibility categories for employment who submit on time EAD renewal applications can be granted automatic extensions for their expiring EADs.
Employers are able to fill in Section 3 of the original Form I-9 provided that it’s the latest version of the form. If the original Form I-9 is older, the employer must fill in Section 3 or complete a completely new I-9 with the current version. In either scenario the employer should join the new Form I-9 to the older one.
If an employee issued an acknowledgment of a document at the time of completing the I-9 and was not able to provide a receipt, the employee is given 90 days to provide the employer the updated document. Employers must utilize Section 3 of the current Form I-9 to alter the information or draw an outline of the old information so that it is legible. Once the line is drawn, it is time to insert the new information and mark the new information and then ink it. If the employee is able to present an acceptable document within the stipulated time and the employer is required to complete Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms that list green cards that have expired must not be updated. Green cards indicate permanent residency in the United States, and they expire in the same manner as driver’s licenses do. The expiration date doesn’t indicate that the holder is no longer authorized to work in the U.S.
Employers can also opt to update the Form I-9 in Section 3 in the event of an identity change, but there isn’t a requirement to do so.
