Are Employers Legally Required To Reverify Or Update I-9 Documents?

2022 I9 Form Instructions – Employers must reverify employee documentation at the time that an employee’s employment authorization (EAD) or receipt is due to expire. Reverification must be done not later than the expiration date for the authorization to work. If the employer is unable to reverify the work authorization, then the worker’s employment may end. Temporary workers with work visas are advised to file for extensions no later than 90 days before the expiration date of their EAD. Some employment eligibility categories may be entitled to automatic extensions for their expired EADs in the event that they file timely EAD renewal requests.

Employers may complete the Section 3 of the Form I-9 originally used only if the original is the current version of the form. If the original Form I-9 is older, the employer should fill in Section 3 or complete a completely new I-9 with the current version. The employer should join the updated Form I-9 to the original.

An employee who gave an acknowledgement for a document when completing the I-9 initial form has 90 days to present the employer with a new form. When that happens, the employer must use Section 3 on the current version of the Form I-9 to modify the information or draw a line through the previous information (so that it remains legible) and then add the new information, and then sign and initial the new information. If the employee presents another acceptable document within the specified time that the employer has to fill out Section 2 of the current Form I-9. Attach it to the original Form I-9.

I-9 forms that include green cards that have expired and then , they should not be issued again. Green cards guarantee permanent residency within the United States, and they expire in the same manner as driver’s licenses do. However, the expiration date does not mean that the holder has lost their authorization to work in the US.

Employers can also opt to amend the Form I-9 under Section 3 whenever an employee is affected by changed their name, however there’s no requirement to do so.
