2022 I9 Form PDF – Form I-9, which is officially known as the Employment Eligibility Verification, is an official United States Citizenship and Immigration Services form. When Do Employers Have To Update Or Revise Their I-9 Documents?
2022 I9 Form PDF – Employers are required to update the employee’s documents only after the employee’s employment authorization documentation (EAD) or the receipt is expired. Revisions must be made no later than the expiration date of the authorization to work. If the employer is not able to update the work authorization, the worker’s contract may not continue. Temporary work visa holders are advised to file for an extension not later than 90 days prior to the expiration date of their EAD. Certain eligibility categories for employment may be allowed automatic extensions to their expired EADs when they submit in time EAD renewal requests.
Employers may complete Section 3 of the original Form I-9 only if the original is the latest version of the form. If the original Form I-9 is older, the employer must fill out Section 3 or complete a completely new I-9 for the most current version. In either scenario the employer must attach the new Form to the original one.
The employee who signed the receipt for any document while filling out the I-9 initial form has 90 days to present the employer with the replacement document. In that time, the employer should utilize Section 3 on the current version of the Form I-9 to update the information or draw a line along the old information (so that it remains visible) and then insert the new information, then sign and mark the new information. If an employee submits an acceptable document within the stipulated time then the employer should complete Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms with green cards that are expired then should not be reissued. Green cards are permanent residence permit, which can be used within the United States. They expire as driver’s licences do. But, the expiration date is not a sign that the person who holds the card has lost their ability to work in the US.
Employers can also modify Section 3 of Form I-9 in the event that an employee’s name changes. But, it’s not required to do so.
