What Is The Date By Which Employers Must Revise And Update I-9 Documents
2022 I9 Form Printable – Employers are required by law to reverify an employee’s documentation only when the employee’s employment authorization certificate (EAD) or the receipt is expired. Reverification should occur not later than the expiration date of the work authorization. If the employer is not able to reverify the work authorization, then the worker’s employment may not continue. Temporary work visa holders are advised to apply for an extension at least 90 days before expiration date of their EAD. Certain eligibility categories for employment who make timely EAD renewal applications may receive automatic extensions to their expiring EADs.
Employers may fill out Section 3 of the original Form I-9 only if it is the most latest version of the form. If the original was an earlier version of Form I-9 employers must either fill out Section 3 on the current version of the I-9 or fill out a brand new I-9 completely in the current version. In either case the employer should add the new Form I-9 to the previous one.
If an employee provided an acknowledgement for a document upon initially completing the I-9 in the first place, he/she has 90 days to give the employer the replacement document. The employer must use Section 3 of the current Form I-9 to amend the details or draw an outline over the information that was previously provided to ensure it is legible. Once the line has been drawn, it is time to insert the updated information and then make sure to sign and write the change. If the employee can provide another acceptable document within the time limit that the employer has to fill out Section 2 on the latest Form I-9. Attach it to the original Form I-9.
I-9 forms with green cards that have expired and then should not be reissued. Green cards are permanent residence permit that is able to be used within the United States. They expire similar to driver’s licenses. The date of expiration does not mean that the holder has been unable to work in the U.S.
Employers may also amend Section 3 of Form I-9 when an employee’s name is changed. But, it’s not required to do so.
