What Is The Deadline For Employers To Reverify And Correct I-9 Documents

2022 I9 – Employers are required to update an employee’s paperwork only when the employee’s employment authorization form (EAD) or receipt is expired. The reverification process must be completed no later than the expiration date for the work authorization. Employees could lose their job if their employer fails to update the authorization. People who are working on temporary work visas are encouraged to apply for an extension no later than 90 days prior to the date on which they will expire their EAD. Certain employment eligibility categories could be qualified for automatic extensions of expired EADs when they submit timely EAD renewal requests.

Employers are able to fill in Section 3 of the Form I-9 originally used only if it’s the current version of the form. If the original Form I-9 is older, the employer must complete Section 3 or complete a completely new I-9 with the current version. In either of these scenarios, the employer must attach the new Form I-9 to the original one.

I-9 forms that have green cards that are expired the time they expire, they shouldn’t be issued. Green cards are permanent residence permit that can be used in the United States. They expire like driver’s licenses. The date of expiration doesn’t mean that the holder is no longer able to work within the U.S.

Employers can also update Section 3 of Form I-9 if the employee’s name is changed. But, it’s not required.
