What Is The Time Frame For Employers To Revise And Correct I-9 Documents
Acceptable I-9 Documents 2022 – Employers must reverify employee documentation at the time that an employees’ employment authorization (EAD) or receipt expires. Reverification must be done no later than the expiration date for the work authorization. The worker could lose their job if the employer does not reverify the authorization. Workers who have temporary work visas are urged to file for extensions at least 90 days before the expiration date of their EAD. Some employment eligibility categories may be allowed automatic extensions of their expired EADs if they file promptly EAD renewal requests.
Employers can fill out the Section 3 of the original Form I-9, if the original version is latest version of the form. If the original Form I-9 is older, the employer should complete Section 3 or complete a completely new I-9 with the current version. The employer must add the new Form I-9 with the original.
The employee who signed an acknowledgment of a document when completing the I-9 initial form will have 90 days to present their employer with the replacement document. When that happens, the employer should utilize Section 3 on the current version of the form to correct the information, or draw a line through the previous information (so that it is still accessible) to insert the updated information, then sign and acknowledge the modification. If, within the 90-day period, the employee wants to present a different acceptable document which is not the document that the receipt was issued for, the employer should complete Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of the reason in the additional information box included on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that include green cards that have expired since the time they expire, they shouldn’t be issued. Green cards are proof of permanent residence in the United States, and they expire the same way as driver’s licenses do. The date of expiration doesn’t mean that the holder is no longer authorized to work within the U.S.
Employers are also able to modify the Form I-9 in Section 3 whenever an employee is affected by an identity change, but there is no obligation to do this.
