Are Employers Legally Required To Reverify Or Update I-9 Documents?
Acceptable I9 Documents 2022 – Employers must update employee documents at the time that an employees’ employment authorization (EAD) or receipt expires. Revisions must be made not later than the expiration date for the work authorization. Employees could be fired if their employer fails to update the authorization. Employers who employ temporary work visas are encouraged to file for an extension no later than 90 days prior to the date on which they will expire their EAD. Certain eligibility categories for employment who are able to submit early EAD renewal applications can be granted automatic extensions of their expired EADs.
If the original form is current employers can fill in the Section 3 of the I-9 originally issued. If the original Form I-9 is older, the employer must fill in Section 3 or complete a completely new I-9 for the most current version. In either case the employer should add the new Form I-9 to the older one.
If an employee provided an acknowledgement for a document after completing the I-9 in the first place, he/she has 90 days to show the employer the replacement document. Employers are required to use Section 3 of the current Form I-9 to modify the information or draw an outline through the original information to ensure that it is legible. After the line is drawn, add the updated information and then make sure to sign and write the change. If, within the 90-day period, the employee decides to submit another acceptable document which is not the receipt document was issued to, the employer should complete Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box that is located on page 2 of the Form I-9 or as a separate attachment.
I-9 forms with green cards that have expired and then should not be reissued. The green card is a permanent residence permit that can be used within the United States. They expire similar to driver’s licenses. The expiration date doesn’t suggest that the person who holds the card cannot work within the U.S.
Employers are also able to update Section 3 of Form I-9 if the employee’s name changes. But, it’s not required to do it.
