What Is The Deadline For Employers To Revise And Correct I-9 Documents
Fillable I9 2022 – Employers must reverify employee documentation when employees’ employment authorization (EAD) or receipt expires. Revisions must be made before the date of expiration for the authorization to work. If the employer is not able to renew the authorization, then the worker’s job may not be extended. People who are working on temporary work visas are encouraged to apply for extensions at least 90 days before the expiration date of their EAD. Certain employment eligibility categories who make promptly EAD renewal applications can be granted automatic extensions to their expiring EADs.
If the form originally used is current employers can fill in Section 3 of the original I-9. If the original Form I-9 is older, the employer must complete Section 3 or complete a completely new I-9 for the most current version. In either situation the employer must join the new Form I-9 to the previous one.
If an employee provided a receipt for a document after completing the I-9 and was not able to provide a receipt, the employee has 90 days to give the employer the updated document. At that time, the employer should use Section 3 on the current version of the form to correct the information, or draw a line through the information from the prior version (so that it’s visible) and then add the new information, then sign and initial the new information. If, within the 90-day period, an employee decides to submit another acceptable document that differs from the document the receipt was issued to, the employer should complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box included on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that contain green cards that are expired then should not be reissued. Green cards are permanent residence permit that can be used within the United States. They expire just like driver’s licenses. However, the date they expire is not a sign that the owner has lost their authority to work in America.
Employers can also modify Section 3 of Form I-9 if an employee’s name is changed. However, it is not required to do this.
