What Is The Deadline For Employers To Revise And Update I-9 Documents?
Fillable I9 Form 2022 – Employers are required to reverify the employee’s documentation at the time that an employee’s employment authorization (EAD) or receipt expires. The reverification must be completed before the date of expiration of the authorization. The worker may be fired if the employer does not reverify the authorization. Employees who are on temporary work visas are urged to file for extensions at least 90 days prior to the expiration date of their EAD. Certain categories of employment that are able to submit promptly EAD renewal applications can be granted automatic extensions for their expiring EADs.
Employers may fill out Section 3 of the Form I-9 originally used only if it’s the latest version of the form. If the original Form I-9 is older, the employer should fill out Section 3 or complete a completely new I-9 using the latest version. In either of these scenarios the employer should join the new Form I-9 to the original one.
If an employee issued the document in a receipt upon initially completing the I-9 then he or she has 90 days to give the employer the replacement document. In that time, the employer must use Section 3 on the current version of the form to correct the information, or draw a line over the previous information (so that it remains usable) and then insert the new information, and sign and acknowledge the change. If the employee is able to present an acceptable document within the specified time and the employer is required to complete Section 2 on the new Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that have expired and then should not be reissued. The green card is a permanent residence permit which can be used within the United States. They expire just like driver’s licenses. But, the expiration date does not mean that the holder has lost their authorization to work in the United States.
Employers are also able to update Section 3 of Form I-9 if the employee’s name is changed. However, it’s not required to do so.
