What Is The Deadline For Employers To Revise And Correct I-9 Documents?

Form 1-9 2022 – Employers should reverify documentation for employees when employee’s employment authorization (EAD) or receipt is due to expire. Reverification should occur before the date of expiration for the work authorization. If the employer isn’t able to update the work authorization, then the worker’s contract may end. Temporary visa holders are advised to apply for extensions no later than 90 days prior to the expiration date of their EAD. Certain categories of employment eligibility may be eligible for automatic extensions for their expired EADs in the event that they file timely EAD renewal applications.

If the form originally used is in use employers can fill in the Section 3 of the I-9 originally issued. If the original Form I-9 is older, employers must fill in Section 3 or complete a completely new I-9 on the current version. In either scenario the employer has to attach the new Form to the previous one.

The employee who signed an acknowledgement for a document when completing the I-9 initial form is given 90 days to present their employer with the replacement document. At that time, the employer should make use of Section 3 on the current version of the form to correct the information, or draw a line over the information from the prior version (so that it is still accessible) and then insert the new information, then sign and initial the change. If the employee is able to present another acceptable document within the time limit and the employer is required to complete Section 2 of the current Form I-9. Attach it to the original Form I-9.

I-9 forms that contain green cards which have expired should not be reverified. Green cards are proof of permanent residence within the United States, and they expire the same way as driver’s licenses do. The expiration date does not mean that the holder is no longer authorized to work within the U.S.

Employers can also opt to change the information on the Form I-9 within Section 3 in the event of a name change, but there’s no requirement to do this.
