Are Employers Legally Required To Update Or Revise I-9 Documents?
Form I 9 2022 – Employers must reverify employee documentation whenever an employee’s employment authorization (EAD) or receipt expires. Reverification should be done not later than the expiration date for the authorization to work. The worker may be fired if their employer fails to update the authorization. Temporary work visa holders are advised to apply for an extension at least 90 days before the expiration date of their EAD. Certain eligibility categories for employment may be qualified for automatic extensions for their expired EADs in the event that they file promptly EAD renewal applications.
If the form originally used is current employers may complete the Section 3 of the original I-9. If the original Form I-9 is older, the employer should complete Section 3 or complete a completely new I-9 with the current version. The employer must attach the updated Form I-9 with the original.
If an employee provided an acknowledgement for a document at the time of completing the I-9, he or she has 90 days to give the employer the updated document. Employers must utilize Section 3 of the current Form I-9 to amend the information or draw an outline over the information that was previously provided to ensure it can be read. After the line is drawn, the employer must insert the updated information and then mark the new information and then ink it. If, during the 90-day timeframe, the employee wants to present a different acceptable document, which differs from the receipt that was issued to and the employer is required to complete Section 2 on a new Form I-9 and attach it to the original Form I-9 and provide a note of clarification either in the additional information box located on the 2nd page of the Form I-9 or as a separate attachment.
I-9 forms that list green cards which have expired must not be updated. Green cards guarantee permanent residency within the United States, and they expire as driver’s licences do. The date of expiration doesn’t suggest that the person who holds the card has been unable to work in the U.S.
Employers are also able to modify the Form I-9 in Section 3 when an employee has an identity change, but there’s no requirement to do so.
