What Is The Deadline For Employers To Revise And Amend I-9 Documents?
Form I-9 2022 Printable PDF – Employers are required to reverify the documentation of employees only when the employee’s employment authorization document (EAD) or the receipt is expired. The reverification process must be completed no later than the expiration date for the authorization to work. Employees could lose their job if the employer fails to renew the authorization. Temporary work visa holders are advised to apply for an extension not later than 90 days before the expiration date of their EAD. Certain categories of employment eligibility that make promptly EAD renewal applications could be granted automatic extensions to their expiring EADs.
If the form originally used is in use employers may complete the Section 3 of the original I-9. If the original Form I-9 is older, the employer must fill in Section 3 or complete a completely new I-9 for the most current version. Employers should add the new Form I-9 with the original.
A person who has given the receipt for documents when filling out the I-9 initial form has up to 90 days to present their employer with a new form. The employer must use Section 3 of the current Form I-9 to modify the information or draw an outline of the information that was previously provided to ensure it can be read. After the line is drawn, insert the updated information and then mark the new information and then ink it. If, during the 90-day period, an employee is required to provide another acceptable document which is not the document the receipt was issued for The employer should fill out Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box found on page 2 of the Form I-9 or as a separate attachment.
I-9 forms with green cards that are no longer valid then should not be reissued. Green cards guarantee permanent residency within the United States, and they expire just as driver’s licenses do. The date of expiration doesn’t necessarily mean that the owner is no longer authorized to work within the U.S.
Employers may also choose to change the information on the Form I-9 within Section 3 whenever an employee is affected by changed their name, however there’s no requirement to do so.
