Form I-9 2022 – Form I-9, officially known as Employment Eligibility Verification, is an United States Citizenship and Immigration Services form. It is required by the 1986 Immigration Reform and Control Act. It is used to verify identity and legal authorization for all employees who work in the United States. Every employer in America has to complete Form I-9 correctly to hire any employee to work in the United States.

When Are Employers Required To Reverify Or Update I-9 Documents?

Form I-9 2022 – Employers are required to reverify an employee’s paperwork only when the employee’s employment authorization documentation (EAD) or the receipt has expired. Revisions must be made not later than the expiration date of the authorization to work. Employees could be fired if the employer does not reverify the authorization. Employees who are on temporary work visas are advised to apply for extensions at least 90 days before the date on which they will expire their EAD. Certain eligibility categories for employment may be qualified for automatic extensions of their expired EADs by submitting timely EAD renewal requests.

If the form originally used is in use employers may complete the Section 3 of the I-9 originally issued. If the original Form I-9 is older, employers must fill in Section 3 or complete a completely new I-9 for the most current version. The employer should add the new Form I-9 with the original.

An employee who gave an acknowledgment of documents when filling out the I-9 initial form is given 90 days to present his employer with a replacement document. Employers must utilize Section 3 of the current Form I-9 in order to change the details or draw an outline around the old information so that it is legible. Once the line is drawn, the employer must insert the updated information and then sign and ink the change. If, within the 90-day timeframe, the employee decides to submit another acceptable document that is different from the receipt that was issued to and the employer is required to complete Section 2 on a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the box for additional information that is located on page 2 of the Form I-9 or as a separate attachment.

I-9 forms that have green cards that have expired since then , they should not be issued again. Green cards are permanent residence permit that is able to be used in the United States. They expire similar to driver’s licenses. The expiration date does not mean that the holder is no longer able to work within the U.S.

Employers can also opt to modify the Form I-9 in Section 3 in the event of an identity change, but there is no requirement to do so.
