What Is The Date By Which Employers Must Revise And Amend I-9 Documents
Form I 9 For 2022 – Employers are required to reverify the employee’s documents only after the employee’s employment authorization certificate (EAD) or receipt is expired. Reverification should take place before the date of expiration for the work authorization. If the employer fails to renew the authorization, the worker’s job may not continue. People who are working on temporary work visas are encouraged to file for extension requests at least 90 days before the date they expire on their EAD. Some employment eligibility categories may be allowed automatic extensions of their expired EADs if they file in time EAD renewal applications.
Employers may complete the Section 3 of the Form I-9 originally used if the original is the current version of the form. If the original was an earlier version of the Form I-9 Employers must either fill out Section 3 on the current version of the I-9 or complete a new I-9 entirely with the current version. Employers must add the new Form I-9 with the original.
The employee who signed an acknowledgement for documents when filling out the I-9 initial form has 90 days to present his employer with a replacement document. The employer must use Section 3 of the current Form I-9 in order to change the details or draw an outline over the information that was previously provided to ensure it can be read. Once the line is drawn, it is time to insert the new information and mark the new information and then ink it. If an employee submits an acceptable document within the time limit then the employer should complete Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that are expired then should not be reissued. Green cards are permanent residence permit, which can be used in the United States. They expire as driver’s licences do. However, the date they expire doesn’t mean that the holders have lost their right to work in America.
Employers can also opt to update the Form I-9 in Section 3 when an employee has an identity change, but there is no obligation to do so.
