What Is The Deadline For Employers To Update Or Revise I-9 Documents?

Form I9 2022 Download – Employers must reverify employee documentation at the time that an employee’s employment authorization (EAD) or receipt is due to expire. Reverification should occur not later than the date of expiration of the authorization. If the employer is unable to renew the authorization, the worker’s employment may not be extended. Temporary work visa holders are advised to apply for an extension not later than 90 days before the expiration of their EAD. Some employment eligibility categories may be allowed automatic extensions of their expired EADs by submitting promptly EAD renewal applications.

If the form originally used is in use employers can fill in the Section 3 of the original I-9. If the original Form I-9 is older, the employer should fill out Section 3 or complete a completely new I-9 with the current version. The employer should attach the updated Form I-9 to the original.

If an employee provided the document in a receipt when completing the initial form I-9 in the first place, he/she has 90 days to give the employer the updated document. In that time, the employer must use Section 3 on the current version of the I-9 form to change the information, or draw a line across the old information (so that it is still visible) and then insert the new information, and then confirm the new information. If the employee presents another acceptable document within the stipulated time then the employer should complete Section 2 of the current Form I-9. Attach it to the original Form I-9.

I-9 forms that have green cards that have expired since they were issued, should not be renewed. The green card is a permanent residence permit that is able to be used in the United States. They expire as driver’s licences do. But, the expiration date does not mean that the owner has lost their authority to work in the United States.

Employers are also able to update Section 3 of Form I-9 when an employee’s name is changed. But, it’s not required to do this.
