What Is The Deadline For Employers To Reverify And Revise I-9 Documents?
Form I9 2022 PDF – Employers must revise an employee’s paperwork only when the employee’s employment authorization certificate (EAD) or receipt has expired. The reverification must be completed at least one year prior to the date of expiration of the work authorization. If the employer is unable to renew the authorization, then the worker’s work authorization will end. Temporary visa holders are advised to file for an extension at least 90 days prior to the expiration of their EAD. Certain categories of employment that submit promptly EAD renewal applications may receive automatic extensions for their expiring EADs.
Employers may fill out Section 3 of the Form I-9 originally used provided that the original version is latest version of the form. If the original version is an earlier version of the Form I-9 employers must either complete Section 3 on the current version of the I-9 or complete a new I-9 entirely using the latest version. In either of these scenarios the employer has to attach the new Form I-9 to the previous one.
An employee who gave the receipt for documents when filling out the I-9 initial form will have 90 days to present the employer with the replacement document. In that time, the employer should make use of Section 3 on the current version of the I-9 form to change the information or draw a line across the information from the prior version (so that it’s usable) and then add the new information, and sign and confirm the update. If the employee presents another acceptable document within the specified time then the employer should complete Section 2 on the latest Form I-9. Attach it to the original Form I-9.
I-9 forms that have green cards that have expired since the time they expire, they shouldn’t be issued. Green cards are a permanent residence permit, which can be used within the United States. They expire like driver’s licenses. But, the expiration date does NOT mean that the person who holds the card has lost their ability to work in America.
Employers are also able to change the information on the Form I-9 within Section 3 in the event of changed names, however, there is no requirement to do so.
