What Is The Deadline For Employers To Reverify And Revise I-9 Documents

Form I9 2022 Print – Employers should reverify documentation for employees whenever an employees’ employment authorization (EAD) or receipt is due to expire. Reverification should be done prior to the date of expiration for the work authorization. The worker may be fired if the employer fails to update the authorization. People who are working on temporary work visas are urged to apply for an extension at least 90 days prior to the date they expire on their EAD. Certain categories of employment eligibility may be entitled to automatic extensions for their expired EADs by submitting in time EAD renewal requests.

Employers are able to fill in the Section 3 of the Form I-9 originally used if the original version is current version of the form. If the original Form I-9 is older, the employer has to fill in Section 3 or complete a completely new I-9 with the current version. The employer must join the updated Form I-9 with the original.

A worker who provided a receipt for documents when filling out the I-9 initial form has 90 days to present their employer with the replacement document. I-9 forms that list green cards that have expired must not be updated. The green card is a permanent residence permit which can be used within the United States. They expire like driver’s licenses. Employers may also amend Section 3 of Form I-9 in the event that an employee’s name is changed. But, it’s not required.
