Form I9 2022 – Form I-9, which is officially known as the Employment Eligibility Verification, is a United States Citizenship and Immigration Services form. It is required by the 1986 Immigration Reform and Control Act. It is used to confirm identity and legal authorization for all employees working in the United States. Every American employer has to complete Form I-9 correctly for every employee they hire to work in the United States.

When Do Employers Have To Update Or Revise I-9 Documents?
Form I9 2022 – Employers must reverify employee documentation after the employee’s employment authorization (EAD) or receipt is due to expire. Reverification should take place before the date of expiration of the work authorization. The worker could lose their job if the employer fails to renew the authorization. Temporary visa holders are advised to request an extension not later than 90 days prior to the expiration of their EAD. Certain employment eligibility categories could be qualified for automatic extensions of expired EADs if they file on time EAD renewal requests.
Employers can fill out Section 3 of the original Form I-9 provided that it is the most latest version of the form. If the original Form I-9 is older, the employer should fill in Section 3 or complete a completely new I-9 on the current version. In either case, the employer must add the new Form I-9 to the previous one.
If an employee has given an acknowledgement for a document when completing the initial form I-9 then he or she has 90 days to give the employer the replacement document. Employers must utilize Section 3 of the current Form I-9 to modify the details or draw an outline through the information that was previously provided to ensure it can be read. Once the line is drawn, add the updated information and then mark the new information and then ink it. If, within the 90-day period, an employee wants to present a different acceptable document that is different from the document that the receipt was issued for and the employer is required to complete Section 2 on a brand new Form I-9 and attach it to the original Form I-9 and provide a note of clarification either in the box for additional information found on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that include green cards that are now expired shouldn’t be re-issued. Green cards are a permanent residence permit that is able to be used within the United States. They expire as driver’s licences do. But, the expiration date doesn’t mean that the person who holds the card has lost their ability to work in the United States.
Employers can also update Section 3 of Form I-9 if the employee’s name changes. However, it’s not required.
