When Are Employers Required To Revise Or Update I-9 Documents?
I 9 Acceptable Documents 2022 – Employers are required by law to reverify an employee’s documentation only when the employee’s employment authorization form (EAD) or the receipt is expired. Reverification should be done at least one year prior to the date of expiration for the work authorization. The worker could lose their job if the employer fails to renew the authorization. Temporary work visa holders are advised to request extensions no later than 90 days prior to the expiration date of their EAD. Certain categories of employment that file promptly EAD renewal applications may receive automatic extensions of their expired EADs.
Employers can fill out Section 3 of the Form I-9 originally used, if the original is the current version of the form. If the original Form I-9 is older, the employer must fill in Section 3 or complete a completely new I-9 for the most current version. In either scenario the employer has to join the new Form I-9 to the old one.
A person who has given an acknowledgment of documents when filling out the I-9 initial form will have 90 days to present his employer with the new document. Employers are required to use Section 3 of the current Form I-9 in order to change the information or draw an outline through the information that was previously provided to ensure it is legible. After the line has been drawn, the employer must insert the new information and sign and ink the change. If the employee is able to present an acceptable document within the stipulated time that the employer has to fill out Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that are now expired must not be updated. Green cards are permanent residence permit that can be used within the United States. They expire as driver’s licences do. The expiration date does not mean that the holder has been unable to work in the U.S.
Employers may also choose to update the Form I-9 in Section 3 when an employee has an identity change, but there is no requirement to do so.
