I-9 Acceptable Documents – Form I-9, referred to as the Employment Eligibility Verification is a United States Citizenship and Immigration Services document. Mandated by the Immigration Reform and Control Act of 1986, the form is used to confirm the legal identity and authorization to work of all paid employees working in the United States. When Do Employers Have To Reverify Or Update I-9 Documents?
I-9 Acceptable Documents – Employers must update employee documents after the employee’s employment authorization (EAD) or receipt is due to expire. Reverification should be done at least one year prior to the date of expiration for the work authorization. If the employer isn’t able to amend the work authorization, the worker’s work authorization will not be extended. Temporary workers with work visas are advised to request an extension at least 90 days before the expiration date of their EAD. Certain categories of employment eligibility that are able to submit early EAD renewal applications can be granted automatic extensions of their expired EADs.
Employers can fill out the Section 3 of the original Form I-9 provided that the original version is latest version of the form. If the original form is an earlier version of the Form I-9 then the employer must either fill in Section 3 on the current version of the I-9 or fill out a brand new I-9 completely on the current version. Employers must add the new Form I-9 to the original.
A worker who provided an acknowledgement for documents when filling out the I-9 initial form will have 90 days to present their employer with the new document. Employers should use Section 3 of the current Form I-9 to amend the details or draw an outline around the old information so that it can be read. After the line has been drawn, add the updated information and then confirm the change by inking it. If, during the 90-day window, the employee is required to provide another acceptable document which is not the document the receipt was issued for and the employer is required to complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of the reason in the additional information box located on the 2nd page of the Form I-9 or as a separate attachment.
I-9 forms that contain green cards that have expired since the time they expire, they shouldn’t be issued. Green cards are permanent residence permit which can be used in the United States. They expire just like driver’s licenses. However, the expiration date doesn’t mean that the holder has lost their authorization to work in the United States.
Employers are also able to update Section 3 of Form I-9 when an employee’s name changes. However, it’s not required to do this.
