I-9 Documentation – Form I-9, also referred to as the Employment Eligibility Verification is a United States Citizenship and Immigration Services document. It is required under the 1986 Immigration Reform and Control Act. It is used to verify the identity and legal authorisation for all employees within the United States. All U.S. employers must ensure that they have completed Form I-9 correctly for each person they hire for employment within the United States.

When Are Employers Required To Update Or Revise I-9 Documents?
I-9 Documentation – Employers must revise the employee’s documents only after the employee’s employment authorization certificate (EAD) or receipt is expired. Revisions must be made not later than the date of expiration for the authorization to work. If the employer is not able to update the work authorization, then the worker’s employment may end. Temporary work visa holders are advised to file for an extension at least 90 days prior to the expiration date of their EAD. Some employment eligibility categories may be allowed automatic extensions of their expired EADs when they submit on time EAD renewal requests.
Employers can fill out the Section 3 of the original Form I-9 provided that the original is the latest version of the form. If the original version is an earlier version of Form I-9 then the employer must either complete Section 3 on the current version of the I-9 or complete a new I-9 completely with the current version. Employers must join the updated Form I-9 with the original.
If an employee has given an acknowledgment of a document at the time of completing the I-9, he or she is given 90 days to provide employers the new document. Employers must utilize Section 3 of the current Form I-9 to alter the information or draw an outline over the previous information to ensure it can be read. Once the line is drawn, it is time to insert the updated information and then sign and ink the change. If the employee can provide another acceptable document within the time limit and the employer is required to complete Section 2 of the new Form I-9. Attach it to the original Form I-9.
I-9 forms that mention green cards that are now expired should not be reverified. Green cards are a permanent residence permit that can be used in the United States. They expire as driver’s licences do. However, the date of expiration doesn’t mean that the person who holds the card has lost their ability to work in the US.
Employers can also update Section 3 of the Form I-9 when an employee’s name is changed. But, it’s not required to do so.
