I 9 Documents 2022 – Form I-9, officially the Employment Eligibility Verification, is the official Employment Eligibility Verification form. It is a United States Citizenship and Immigration Services form. What Is The Deadline For Employers To Update Or Revise I-9 Documents?
I 9 Documents 2022 – Employers are required to reverify an employee’s documentation only when the employee’s employment authorization form (EAD) or the receipt has expired. Reverification should be done not later than the expiration date of the work authorization. The worker could be fired if their employer fails to renew the authorization. Employees who are on temporary work permits are encouraged to apply for extensions at least 90 days prior to the date on which they will expire their EAD. Some employment eligibility categories may be allowed automatic extensions to their expired EADs if they file in time EAD renewal requests.
Employers may complete Section 3 of the original Form I-9 only if it’s the current version of the form. If the original was a prior version of Form I-9 Employers must either complete Section 3 on the current version of the I-9 or fill out a new I-9 completely using the latest version. In either scenario the employer has to attach the new Form I-9 to the previous one.
A worker who provided a receipt for any document while filling out the I-9 initial form will have 90 days to present his employer with the replacement document. In that time, the employer should utilize Section 3 on the current version of the Form I-9 to update the information, or draw a line through the information from the prior version (so that it remains legible) and then insert the new information, then sign and mark the new information. If the employee can provide another acceptable document within the specified time, the employer must complete Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms that contain green cards that have expired should not be reverified. Green cards are permanent residence permit, which can be used in the United States. They expire just like driver’s licenses. However, the expiration date doesn’t mean that the holder has lost their authorization to work in the United States.
Employers can also update Section 3 of Form I-9 if the employee’s name changes. But, it’s not required to do this.
