What Is The Date By Which Employers Must Revise And Correct I-9 Documents
I-9 Form 2022 Fillable – Employers are required by law to reverify an employee’s paperwork only when the employee’s employment authorization certificate (EAD) or receipt is expired. Reverification should be done prior to the expiration date for the work authorization. If the employer is unable to amend the work authorization, then the worker’s job may be terminated. Temporary work visa holders are advised to file for an extension not later than 90 days before expiration of their EAD. Some employment eligibility categories may be entitled to automatic extensions to their expired EADs if they file in time EAD renewal requests.
If the original form is current, employers may fill out the Section 3 of the original I-9. If the original is an earlier version of Form I-9, the employer should either complete Section 3 on the current version of the I-9 or complete a new I-9 entirely on the current version. In either case the employer should join the new Form I-9 to the previous one.
If an employee gave a receipt for a document when completing the initial form I-9, he or she has 90 days to present the employer the updated document. Employers are required to use Section 3 of the current Form I-9 to amend the information or draw an outline around the old information so that it is legible. After the line is drawn, insert the new information and make sure to sign and write the change. If, within the 90-day window, the employee is required to provide another acceptable document, which differs from the receipt that was issued to, the employer should complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the box for additional information included on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that mention green cards that have expired shouldn’t be re-issued. Green cards are proof of permanent residence in the United States, and they expire the same way as driver’s licenses do. The date of expiration does not necessarily mean that the owner cannot work in the U.S.
Employers also have the option of modify the Form I-9 in Section 3 when an employee’s name changes. a name change, but there is no obligation to do so.
