What Is The Deadline For Employers To Revise And Update I-9 Documents?
I 9 Form 2022 Fillable – Employers are required to reverify the employee’s documentation when employee’s employment authorization (EAD) or receipt is due to expire. Reverification should be done no later than the actual date of expiration of the work authorization. If the employer fails to amend the work authorization, then the worker’s contract may not continue. Employers who employ temporary work visas are urged to file for an extension at least 90 days before the date they expire on their EAD. Certain employment eligibility categories could be qualified for automatic extensions of expired EADs when they submit in time EAD renewal applications.
Employers may fill out the Section 3 of the Form I-9 originally used provided that the original is the current version of the form. If the original Form I-9 is older, the employer should complete Section 3 or complete a completely new I-9 using the latest version. The employer must attach the updated Form I-9 to the original.
The employee who signed the receipt for documents when filling out the I-9 initial form is given 90 days to present the employer with a new form. If, within the 90-day period, the employee chooses to present another acceptable document that is different from the document the receipt was issued to, the employer should complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of clarification either in the additional information box found on page 2 of the Form I-9 or as a separate attachment.
