What Is The Time Frame For Employers To Revise And Update I-9 Documents?
I-9 Form 2022 PDF – Employers are required by law to reverify the documentation of employees only when the employee’s employment authorization certificate (EAD) or the receipt is expired. Revisions must be made before the date of expiration for the work authorization. The worker could be fired if their employer fails to update the authorization. Employers who employ temporary work permits are encouraged to apply for extension requests at least 90 days prior to the date they expire on their EAD. Certain categories of employment that make promptly EAD renewal applications may receive automatic extensions of their expired EADs.
If the form originally used is current, employers may fill out Section 3 of the original I-9. If the original Form I-9 is older, employers must fill out Section 3 or complete a completely new I-9 with the current version. In that time, the employer should make use of Section 3 on the current version of the Form I-9 to update the information, or draw a line across the previous information (so that it’s legible) and then insert the new information, and then sign and acknowledge the change. If, during the 90-day window, the employee wants to present a different acceptable document, which differs from the receipt document was issued then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of the reason in the additional information box found on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that contain green cards that have since expired, should not be renewed. Green cards indicate permanent residency in the United States, and they expire the same way as driver’s licenses do. The expiration date does not necessarily mean that the owner is no longer able to work in the U.S.
Employers can also opt to modify the Form I-9 in Section 3 in the event of changed their name, however there’s no requirement to do so.
