When Do Employers Have To Update Or Revise I-9 Documents?
I-9 Form 2022 Printable – Employers are required by law to reverify an employee’s documentation only when the employee’s employment authorization certificate (EAD) or receipt is expired. Reverification should take place no later than the actual date of expiration of the authorization. If the employer fails to renew the authorization, the worker’s employment may be terminated. Temporary visa holders are advised to apply for an extension at least 90 days before expiration of their EAD. Certain employment eligibility categories who make on time EAD renewal applications may receive automatic extensions to their expiring EADs.
If the form originally used is in use employers may complete Section 3 of the original I-9. If the original is a prior version of Form I-9 then the employer must either complete Section 3 on the current version of the I-9 or fill out a brand new I-9 completely using the latest version. The employer must add the new Form I-9 to the original.
A person who has given a receipt for any document while filling out the I-9 initial form has 90 days to present the employer with a new form. The employer must use Section 3 of the current Form I-9 to alter the details or draw an outline over the old information so that it can be read. I-9 forms that contain green cards that have expired since then , they should not be issued again. Green cards guarantee permanent residency within the United States, and they expire in the same manner as driver’s licenses do. The expiration date doesn’t suggest that the person who holds the card cannot work in the U.S.
Employers may also amend Section 3 of Form I-9 if the employee’s name changes. However, it’s not required to do so.
