What Is The Date By Which Employers Must Revise And Update I-9 Documents
I 9 Form 2022 Printable Form – Employers are required to reverify the employee’s documentation whenever an employee’s employment authorization (EAD) or receipt is due to expire. Revisions must be made before the expiration date for the authorization to work. Employees could be fired if the employer fails to renew the authorization. Temporary work visa holders are advised to apply for an extension at least 90 days prior to the expiration date of their EAD. Certain eligibility categories for employment who are able to submit on time EAD renewal applications may receive automatic extensions of their expired EADs.
Employers may complete Section 3 of the Form I-9 originally used only if it’s the current version of the form. If the original Form I-9 is older, the employer has to complete Section 3 or complete a completely new I-9 using the latest version. Employers should attach the updated Form I-9 to the original.
If an employee issued a receipt for a document after completing the I-9 and was not able to provide a receipt, the employee has 90 days to show employers the new document. Employers are required to use Section 3 of the current Form I-9 in order to change the information or draw an outline over the old information so that it is legible. After the line is drawn, the employer must insert the new information and sign and ink the change. If an employee submits an acceptable document within the stipulated time and the employer is required to complete Section 2 on the new Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that are now expired should not be reverified. Green cards signify permanent residence within the United States, and they expire the same way as driver’s licenses do. But, the expiration date does not mean that the owner has lost their authority to work in the United States.
Employers also have the option of update the Form I-9 in Section 3 when an employee has changed their name, however there isn’t a requirement to do this.
