I-9 Form 2022 – Form I-9, officially known as Employment Eligibility Verification, is an official United States Citizenship and Immigration Services form. It is mandated under the 1986 Immigration Reform and Control Act. It is used to authenticate identity and authorization for all employees who work within the United States. All U.S. employers must ensure the correct completion of Form I-9 for each employee they employ for employment within the United States.

Are Employers Legally Required To Update Or Revise I-9 Documents?
I-9 Form 2022 – Employers are required to update an employee’s paperwork only when the employee’s employment authorization form (EAD) or receipt has expired. The reverification process must be completed before the expiration date for the authorization to work. If the employer fails to reverify the work authorization, the worker’s work authorization will be terminated. People who are working on temporary work permits are encouraged to file for extension requests at least 90 days prior to the expiration date of their EAD. Certain eligibility categories for employment who are able to submit early EAD renewal applications could be granted automatic extensions of their expiring EADs.
Employers can fill out the Section 3 of the original Form I-9, if it is the most latest version of the form. If the original was a prior version of Form I-9, the employer should either fill in Section 3 on the current version of the I-9 or complete a new I-9 completely on the current version. Employers must attach the updated Form I-9 with the original.
An employee who gave the receipt for a document when completing the I-9 initial form has up to 90 days to present his employer with the replacement document. The employer must use Section 3 of the current Form I-9 to modify the details or draw an outline around the previous information to ensure it is legible. Once the line is drawn, the employer must insert the updated information and then make sure to sign and write the change. If the employee is able to present another acceptable document within the specified time that the employer has to fill out Section 2 on the latest Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that are now expired shouldn’t be re-issued. Green cards are a permanent residence permit that is able to be used in the United States. They expire like driver’s licenses. However, the date they expire is not a sign that the holder has lost their authorization to work in the US.
Employers may also amend Section 3 of the Form I-9 when an employee’s name changes. However, it is not required to do this.
