What Is The Deadline For Employers To Revise And Correct I-9 Documents

I 9 Forms 2022 – Employers should reverify documentation for employees whenever an employee’s employment authorization (EAD) or receipt is due to expire. The reverification must be completed before the date of expiration of the work authorization. If the employer fails to update the work authorization, the worker’s employment may end. Employees who are on temporary work visas are encouraged to apply for extensions at least 90 days prior to the expiration date of their EAD. Certain employment eligibility categories could be eligible for automatic extensions to their expired EADs if they file timely EAD renewal requests.

If the form originally used is current, employers may fill out the Section 3 of the original I-9. If the original was an earlier version of the Form I-9 then the employer must either fill out Section 3 on the current version of the I-9 or complete a new I-9 completely in the current version. The employer should join the updated Form I-9 with the original.

A person who has given a receipt for any document while filling out the I-9 initial form will have 90 days to provide the employer with the replacement document. The employer must use Section 3 on the current version of the I-9 form to change the information, or draw a line across the information from the prior version (so that it is still visible) and then insert the new information, then sign and acknowledge the new information. If, within the 90-day timeframe, the employee chooses to present another acceptable document which is not the document that the receipt was issued for then the employer must complete Section 2 on a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the additional information box found on page 2 of the Form I-9 or as a separate attachment.

I-9 forms that mention green cards that have expired shouldn’t be re-issued. Green cards are a permanent residence permit, which can be used within the United States. They expire just like driver’s licenses. However, the expiration date is not a sign that the holder has lost their authorization to work in the United States.

Employers are also able to update Section 3 of the Form I-9 if an employee’s name changes. However, it is not required to do it.
