What Is The Deadline For Employers To Revise And Correct I-9 Documents

I-9 Forms 2022 – Employers must update employee documents whenever an employees’ employment authorization (EAD) or receipt is due to expire. Reverification should occur at least one year prior to the date of expiration of the authorization. If the employer isn’t able to amend the work authorization, the worker’s employment may be terminated. Workers who have temporary work permits are encouraged to file for extensions at least 90 days before the date on which they will expire their EAD. I-9 forms that list green cards that are now expired shouldn’t be re-issued. Green cards signify permanent residence within the United States, and they expire just as driver’s licenses do. The date of expiration does not indicate that the holder is no longer able to work in the U.S.

Employers also have the option of change the information on the Form I-9 within Section 3 in the event of an identity change, but there is no requirement to do so.
