What Is The Deadline For Employers To Reverify And Correct I-9 Documents?

I-9 Instructions 2022 – Employers must revise an employee’s documentation only when the employee’s employment authorization document (EAD) or receipt is expired. Reverification must be done before the expiration date for the work authorization. The worker could be fired if the employer does not reverify the authorization. Employers who employ temporary work permits are encouraged to file for an extension at least 90 days prior to the date on which they will expire their EAD. Certain employment eligibility categories could be qualified for automatic extensions of expired EADs in the event that they file timely EAD renewal applications.

Employers can fill out the Section 3 of the original Form I-9 provided that the original is the current version of the form. If, within the 90-day window, the employee chooses to present another acceptable document that is different from the document the receipt was issued to then the employer must complete Section 2 on a brand new Form I-9 and attach it to the original Form I-9 and provide a note of the reason in the box for additional information located on the 2nd page of the Form I-9 or as a separate attachment.

I-9 forms that include green cards that are no longer valid they were issued, should not be renewed. Green cards are a permanent residence permit that is able to be used within the United States. They expire like driver’s licenses. However, the expiration date doesn’t mean that the owner has lost their authority to work in the United States.

Employers are also able to modify the Form I-9 in Section 3 in the event of changed their name, however there isn’t a requirement to do so.
