What Is The Date By Which Employers Must Revise And Update I-9 Documents
I 9 Verification 2022 – Employers are required to reverify an employee’s paperwork only when the employee’s employment authorization certificate (EAD) or receipt has expired. Reverification must be done not later than the date of expiration for the authorization to work. If the employer isn’t able to renew the authorization, the worker’s employment may not continue. Employers who employ temporary work visas are urged to apply for an extension at least 90 days before the date on which they will expire their EAD. Certain eligibility categories for employment may be allowed automatic extensions of expired EADs in the event that they file promptly EAD renewal requests.
Employers are able to fill in the Section 3 of the Form I-9 originally used provided that the original is the latest version of the form. If the original was a prior version of Form I-9, the employer should either fill in Section 3 on the current version of the I-9 or complete a new I-9 completely with the current version. In either situation, the employer must attach the new Form I-9 to the older one.
If an employee gave an acknowledgment of a document at the time of completing the I-9 then he or she is given 90 days to provide the employer the updated document. In that time, the employer should make use of Section 3 on the current version of the form to correct the information or draw a line through the original information (so that it remains legible) to insert the updated information, and sign and mark the modification. If the employee presents an acceptable document within the time limit that the employer has to fill out Section 2 on the new Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards which have expired shouldn’t be re-issued. Green cards indicate permanent residency in the United States, and they expire in the same manner as driver’s licenses do. However, the date they expire is not a sign that the owner has lost their authority to work in America.
Employers may also amend Section 3 of Form I-9 in the event that an employee’s name is changed. But, it’s not required to do it.
