What Is The Date By Which Employers Must Revise And Update I-9 Documents

I9 2022 Form Printable – Employers are required to reverify the employee’s documentation when employee’s employment authorization (EAD) or receipt is due to expire. The reverification must be completed at least one year prior to the date of expiration for the work authorization. If the employer fails to amend the work authorization, the worker’s employment may be terminated. Temporary visa holders are advised to apply for an extension not later than 90 days before expiration date of their EAD. Certain eligibility categories for employment who make promptly EAD renewal applications may receive automatic extensions of their expiring EADs.

If the form originally used is in use employers are able to fill out the Section 3 of the I-9 originally issued. If the original Form I-9 is older, the employer should complete Section 3 or complete a completely new I-9 for the most current version. Employers should join the updated Form I-9 to the original.

If an employee gave an acknowledgment of a document after completing the I-9 in the first place, he/she has 90 days to give an employer the replacement document. When that happens, the employer must use Section 3 on the current version of the Form I-9 to modify the information or draw a line along the information from the prior version (so that it remains visible) and then insert the new information, and then initial the update. If an employee submits another acceptable document within the stipulated time then the employer should complete Section 2 of the current Form I-9. Attach it to the original Form I-9.

I-9 forms that contain green cards that have since expired should not be reverified. Green cards are proof of permanent residence in the United States, and they expire in the same manner as driver’s licenses do. However, the date of expiration doesn’t mean that the holder has lost their authorization to work in the United States.

Employers may also amend Section 3 of the Form I-9 in the event that an employee’s name is changed. However, it’s not required to do it.
