I9 2022 – Form I-9, referred to as the Employment Eligibility Verification is a United States Citizenship and Immigration Services document. It is required by the 1986 Immigration Reform and Control Act. It is used to verify identity and legal authorisation for all employees within the United States. Every American employer has to complete the Form I-9 correctly for every employee they hire to work in the United States.

What Is The Deadline For Employers To Reverify And Update I-9 Documents
I9 2022 – Employers are required to reverify an employee’s paperwork only when the employee’s employment authorization form (EAD) or receipt is expired. The reverification must be completed not later than the date of expiration for the work authorization. Employees could lose their job if their employer fails to reverify the authorization. Temporary workers with work visas are advised to apply for an extension not later than 90 days before the expiration of their EAD. Some employment eligibility categories may be eligible for automatic extensions for their expired EADs if they file in time EAD renewal applications.
If the original form is in use, employers may fill out Section 3 of the original I-9. If the original Form I-9 is older, the employer has to fill in Section 3 or complete a completely new I-9 with the current version. In either case the employer has to attach the new Form I-9 to the old one.
A worker who provided the receipt for a document when completing the I-9 initial form will have 90 days to present their employer with a new form. In that time, the employer should use Section 3 on the current version of the I-9 form to change the information or draw a line across the information from the prior version (so that it remains visible) and then add the new information, and then mark the modification. If, within the 90-day timeframe, the employee wants to present a different acceptable document that is different from the document that the receipt was issued for then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box located on the 2nd page of the Form I-9 or as a separate attachment.
I-9 forms that contain green cards that have since expired should not be reverified. The green card is a permanent residence permit, which can be used in the United States. They expire as driver’s licences do. The date of expiration doesn’t suggest that the person who holds the card is no longer authorized to work in the U.S.
Employers may also choose to amend the Form I-9 under Section 3 whenever an employee is affected by changed names, however, there is no requirement to do so.
