What Is The Deadline For Employers To Reverify And Revise I-9 Documents?
I9 Acceptable Documents 2022 – Employers must update employee documents when employee’s employment authorization (EAD) or receipt is due to expire. Revisions must be made before the expiration date for the work authorization. The worker may be fired if the employer fails to renew the authorization. Temporary workers with work visas are advised to apply for an extension no later than 90 days prior to the expiration of their EAD. Certain categories of employment eligibility may be allowed automatic extensions for their expired EADs when they submit timely EAD renewal requests.
Employers can fill out the Section 3 of the Form I-9 originally used only if it is the most latest version of the form. If the original form is a prior version of Form I-9, the employer should either fill in Section 3 on the current version of the I-9 or complete a new I-9 entirely in the current version. In either of these scenarios the employer has to attach the new Form to the original one.
A person who has given a receipt for any document while filling out the I-9 initial form has 90 days to present the employer with a replacement document. The employer must use Section 3 of the current Form I-9 to modify the information or draw an outline of the original information to ensure that it can be read. Once the line is drawn, add the updated information and then sign and ink the change. If the employee presents another acceptable document within the specified time that the employer has to fill out Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms with green cards that are expired then should not be reissued. Green cards are proof of permanent residence in the United States, and they expire just as driver’s licenses do. However, the expiration date doesn’t mean that the owner has lost their authority to work in the United States.
Employers also have the option of amend the Form I-9 under Section 3 whenever an employee is affected by an identity change, but there isn’t a requirement to do so.
