What Is The Deadline For Employers To Reverify Or Update I-9 Documents?
I9 Document List – Employers should reverify documentation for employees when employee’s employment authorization (EAD) or receipt is due to expire. Reverification should be done not later than the expiration date for the authorization to work. The worker may lose their job if their employer fails to reverify the authorization. People who are working on temporary work visas are encouraged to file for extensions at least 90 days prior to the date they expire on their EAD. Certain categories of employment eligibility that file promptly EAD renewal applications can be granted automatic extensions of their expired EADs.
Employers may complete Section 3 of the Form I-9 originally used provided that it is the most current version of the form. If the original Form I-9 is older, the employer should complete Section 3 or complete a completely new I-9 using the latest version. In either case, the employer must attach the new Form to the old one.
If an employee gave the document in a receipt at the time of completing the I-9 then he or she has 90 days to present the employer the updated document. When that happens, the employer should utilize Section 3 on the current version of the form to correct the information or draw a line over the old information (so that it is still usable) and then insert the new information, and then mark the modification. If an employee submits another acceptable document within the deadline then the employer should complete Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that have expired, should not be renewed. Green cards indicate permanent residency in the United States, and they expire as driver’s licences do. But, the expiration date does not mean that the holder has lost their authorization to work in America.
Employers may also choose to amend the Form I-9 under Section 3 in the event of an identity change, but there’s no requirement to do this.
