I9 Documents 2022 – Form I-9, which is officially known as the Employment Eligibility Verification, is an United States Citizenship and Immigration Services form. It is mandated by the 1986 Immigration Reform and Control Act. It is used to confirm identity and legal authorization for all employees working in the United States. When Do Employers Have To Update Or Revise Their I-9 Documents?
I9 Documents 2022 – Employers must reverify employee documentation at the time that an employees’ employment authorization (EAD) or receipt expires. Reverification should take place before the expiration date of the work authorization. If the employer is unable to renew the authorization, then the worker’s work authorization will end. Employees who are on temporary work visas are encouraged to file for extensions at least 90 days before the date they expire on their EAD. Certain categories of employment eligibility that make on time EAD renewal applications could be granted automatic extensions to their expiring EADs.
Employers may fill out the Section 3 of the original Form I-9, if the original is the current version of the form. If the original form is an earlier version of Form I-9, the employer should either fill out Section 3 on the current version of the I-9 or complete a new I-9 completely with the current version. In either situation the employer has to add the new Form I-9 to the previous one.
A person who has given an acknowledgement for a document when completing the I-9 initial form has up to 90 days to present the employer with the new document. Employers should use Section 3 of the current Form I-9 to modify the information or draw an outline through the old information so that it is legible. Once the line is drawn, the employer must insert the new information and confirm the change by inking it. If, within the 90-day period, an employee chooses to present another acceptable document that is different from the document that the receipt was issued The employer should fill out Section 2 on a brand new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the box for additional information included on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that list green cards that are now expired, should not be renewed. Green cards are proof of permanent residence in the United States, and they expire just as driver’s licenses do. The expiration date doesn’t indicate that the holder cannot work in the U.S.
Employers may also amend Section 3 of the Form I-9 when an employee’s name is changed. However, it is not required to do this.
