What Is The Deadline For Employers To Revise And Revise I-9 Documents?

I9 Documents – Employers are required by law to reverify the documentation of employees only when the employee’s employment authorization document (EAD) or receipt has expired. Reverification should be done prior to the date of expiration for the work authorization. Employees could be fired if the employer fails to update the authorization. Employers who employ temporary work visas are encouraged to file for extensions at least 90 days prior to the date on which they will expire their EAD. Certain eligibility categories for employment who make timely EAD renewal applications could receive automatic extensions of their expiring EADs.

If the original form is current, employers may fill out the Section 3 of the original I-9. If the original Form I-9 is older, the employer should complete Section 3 or complete a completely new I-9 with the current version. The employer should be sure to attach the latest Form I-9 with the original.

If an employee has given an acknowledgment of a document when completing the initial form I-9, he or she has 90 days to show the employer the updated document. Employers should use Section 3 of the current Form I-9 in order to change the information or draw an outline around the original information to ensure that it is legible. Once the line has been drawn, insert the new information , then confirm the change by inking it. If, during the 90-day window, the employee wants to present a different acceptable document, which differs from the receipt document was issued for then the employer must complete Section 2 on a brand new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the additional information box found on page 2 of the Form I-9 or as a separate attachment.

I-9 forms that contain green cards that have expired must not be updated. The green card is a permanent residence permit, which can be used in the United States. They expire as driver’s licences do. The expiration date does not suggest that the person who holds the card has been unable to work in the U.S.

Employers may also amend Section 3 of the Form I-9 if an employee’s name is changed. However, it is not required to do so.
