I9 Form 2022 Instructions – Employers must update employee documents at the time that an employee’s employment authorization (EAD) or receipt expires. The reverification must be completed at least one year prior to the date of expiration of the authorization. If the employer is unable to amend the work authorization, the worker’s job may not continue. In either of these scenarios the employer has to attach the new Form I-9 to the original one.

If an employee provided an acknowledgment of a document at the time of completing the I-9 in the first place, he/she is given 90 days to provide the employer the replacement document. Employers should use Section 3 of the current Form I-9 to modify the details or draw an outline of the original information to ensure that it can be read. Once the line is drawn, it is time to insert the new information , then mark the new information and then ink it. If, within the 90-day period, an employee decides to submit another acceptable document that differs from the receipt that was issued to then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box located on the 2nd page of the Form I-9 or as a separate attachment.

I-9 forms that have green cards that have expired since then should not be reissued. Green cards indicate permanent residency in the United States, and they expire just as driver’s licenses do. The expiration date doesn’t mean that the holder is no longer able to work in the U.S.
