What Is The Deadline For Employers To Revise And Amend I-9 Documents
I9 Form 2022 Instructions – Employers must update employee documents at the time that an employee’s employment authorization (EAD) or receipt expires. The reverification must be completed at least one year prior to the date of expiration of the authorization. If the employer is unable to amend the work authorization, the worker’s job may not continue. Workers who have temporary work visas are encouraged to apply for extensions at least 90 days before the expiration date of their EAD. Certain categories of employment eligibility that are able to submit timely EAD renewal applications could receive automatic extensions of their expiring EADs.
Employers can fill out the Section 3 of the original Form I-9 if the original version is current version of the form. If the original Form I-9 is older, the employer should fill out Section 3 or complete a completely new I-9 with the current version. If, within the 90-day period, an employee decides to submit another acceptable document that differs from the receipt that was issued to then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box located on the 2nd page of the Form I-9 or as a separate attachment.
I-9 forms that have green cards that have expired since then should not be reissued. Green cards indicate permanent residency in the United States, and they expire just as driver’s licenses do. The expiration date doesn’t mean that the holder is no longer able to work in the U.S.
Employers are also able to update Section 3 of Form I-9 if an employee’s name changes. But, it’s not required to do so.
