When Do Employers Have To Update Or Revise Their I-9 Documents?
I9 Form 2022 PDF – Employers are required to reverify the employee’s documentation whenever an employees’ employment authorization (EAD) or receipt is due to expire. Reverification should be done prior to the date of expiration for the work authorization. If the employer isn’t able to renew the authorization, the worker’s job may be terminated. Temporary workers with work visas are advised to file for extensions no later than 90 days prior to the expiration date of their EAD. Certain eligibility categories for employment who file timely EAD renewal applications can be granted automatic extensions of their expired EADs.
Employers can fill out Section 3 of the Form I-9 originally used provided that the original version is latest version of the form. Employers should use Section 3 of the current Form I-9 to modify the details or draw an outline through the old information so that it can be read. Once the line has been drawn, insert the new information , then make sure to sign and write the change. If an employee submits another acceptable document within the deadline that the employer has to fill out Section 2 on the latest Form I-9. Attach it to the original Form I-9.
I-9 forms that have green cards that are expired then should not be reissued. The green card is a permanent residence permit that can be used in the United States. They expire similar to driver’s licenses. But, the expiration date does NOT mean that the holders have lost their right to work in the United States.
Employers can also modify Section 3 of the Form I-9 when an employee’s name is changed. However, it is not required.
