What Is The Deadline For Employers To Reverify And Correct I-9 Documents?
I9 Form 2022 Printable Spanish – Employers should reverify documentation for employees after the employee’s employment authorization (EAD) or receipt expires. The reverification must be completed not later than the expiration date of the work authorization. If the employer is unable to amend the work authorization, the worker’s job may be terminated. Temporary work visa holders are advised to apply for an extension no later than 90 days prior to the expiration of their EAD. Certain categories of employment that submit promptly EAD renewal applications can be granted automatic extensions of their expired EADs.
If the original form is current, employers may fill out the Section 3 of the I-9 originally issued. If the original Form I-9 is older, the employer should fill out Section 3 or complete a completely new I-9 with the current version. In either case the employer has to join the new Form I-9 to the previous one.
If an employee provided an acknowledgment of a document upon initially completing the I-9, he or she has 90 days to show an employer the replacement document. When that happens, the employer should utilize Section 3 on the current version of the form to correct the information or draw a line through the original information (so that it is still usable) to insert the updated information, and sign and acknowledge the modification. If an employee submits another acceptable document within the stipulated time then the employer should complete Section 2 on the new Form I-9. Attach it to the original Form I-9.
I-9 forms with green cards that are no longer valid the time they expire, they shouldn’t be issued. Green cards are a permanent residence permit that can be used within the United States. They expire similar to driver’s licenses. But, the expiration date does NOT mean that the person who holds the card has lost their ability to work in the United States.
Employers can also modify Section 3 of Form I-9 if the employee’s name changes. However, it is not required to do so.
