What Is The Deadline For Employers To Update Or Revise I-9 Documents?
I9 Form 2022 Spanish – Employers are required by law to reverify the employee’s documents only after the employee’s employment authorization document (EAD) or receipt is expired. Reverification should be done no later than the actual date of expiration for the work authorization. The worker may be fired if the employer fails to reverify the authorization. Employees who are on temporary work visas are encouraged to file for extension requests at least 90 days before the date they expire on their EAD. Certain eligibility categories for employment may be eligible for automatic extensions to their expired EADs if they file in time EAD renewal requests.
If the form originally used is current, employers may fill out the Section 3 of the I-9 originally issued. If the original was an earlier version of Form I-9 employers must either fill out Section 3 on the current version of the I-9 or complete a new I-9 entirely on the current version. In either scenario the employer has to attach the new Form I-9 to the previous one.
If an employee has given a receipt for a document at the time of completing the I-9 and was not able to provide a receipt, the employee has 90 days to show an employer the replacement document. At that time, the employer should utilize Section 3 on the current version of the Form I-9 to modify the information or draw a line through the original information (so that it’s usable) and then insert the new information, and then sign and mark the modification. If, during the 90-day period, the employee chooses to present another acceptable document, which differs from the receipt that was issued to then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of clarification either in the additional information box found on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that include green cards that are expired then , they should not be issued again. The green card is a permanent residence permit which can be used within the United States. They expire like driver’s licenses. The expiration date doesn’t necessarily mean that the owner is no longer authorized to work in the U.S.
Employers can also update Section 3 of Form I-9 if the employee’s name changes. However, it is not required.
