What Is The Time Frame For Employers To Revise And Amend I-9 Documents
I9 Form 2022 – Employers must reverify employee documentation whenever an employee’s employment authorization (EAD) or receipt expires. Reverification should be done before the expiration date for the authorization to work. The worker could be fired if the employer fails to renew the authorization. Employees who are on temporary work visas are encouraged to file for extensions at least 90 days before the date they expire on their EAD. Certain employment eligibility categories could be qualified for automatic extensions of their expired EADs if they file on time EAD renewal requests.
Employers may complete Section 3 of the original Form I-9 provided that the original version is latest version of the form. If the original form is a prior version of Form I-9, the employer should either complete Section 3 on the current version of the I-9 or fill out a brand new I-9 entirely with the current version. In either case the employer has to join the new Form I-9 to the older one.
The employee who signed a receipt for an item when filling out the I-9 initial form is given 90 days to present his employer with the replacement document. Employers are required to use Section 3 of the current Form I-9 to modify the information or draw an outline through the previous information to ensure it can be read. Once the line is drawn, it is time to insert the new information and sign and ink the change. If the employee presents another acceptable document within the stipulated time that the employer has to fill out Section 2 on the latest Form I-9. Attach it to the original Form I-9.
I-9 forms that contain green cards which have expired should not be reverified. Green cards indicate permanent residency in the United States, and they expire in the same manner as driver’s licenses do. The expiration date doesn’t mean that the holder cannot work in the U.S.
Employers are also able to amend the Form I-9 under Section 3 when an employee has an identity change, but there’s no requirement to do this.
