What Is The Deadline For Employers To Update Or Revise I-9 Documents?
I9 Form Fillable 2022 – Employers are required by law to reverify an employee’s documentation only when the employee’s employment authorization document (EAD) or the receipt is expired. Reverification must be done prior to the expiration date of the work authorization. If the employer is unable to renew the authorization, then the worker’s employment may not continue. Employees who are on temporary work visas are advised to file for an extension at least 90 days prior to the expiration date of their EAD. Certain categories of employment that make promptly EAD renewal applications may receive automatic extensions for their expiring EADs.
Employers may fill out the Section 3 of the Form I-9 originally used, if the original is the latest version of the form. If the original Form I-9 is older, employers must fill out Section 3 or complete a completely new I-9 with the current version. In either of these scenarios the employer must attach the new Form I-9 to the previous one.
A person who has given a receipt for a document when completing the I-9 initial form has up to 90 days to present their employer with a replacement document. Employers should use Section 3 of the current Form I-9 to amend the information or draw an outline over the previous information to ensure it is legible. Once the line has been drawn, insert the new information , then mark the new information and then ink it. If, within the 90-day period, the employee chooses to present another acceptable document, which differs from the document that the receipt was issued to, the employer should complete Section 2 on a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the box for additional information that is located on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that include green cards which have expired must not be updated. Green cards guarantee permanent residency in the United States, and they expire in the same manner as driver’s licenses do. However, the date they expire is not a sign that the owner has lost their authority to work in the United States.
Employers also have the option of change the information on the Form I-9 within Section 3 when an employee’s name changes. a name change, but there’s no requirement to do this.
