What Is The Deadline For Employers To Reverify And Amend I-9 Documents?
I9 Forms 2022 Printable – Employers must reverify employee documentation when employee’s employment authorization (EAD) or receipt expires. Reverification should occur no later than the actual date of expiration of the work authorization. The worker may lose their job if their employer fails to renew the authorization. People who are working on temporary work visas are urged to apply for an extension at least 90 days prior to the date on which they will expire their EAD. Certain eligibility categories for employment may be qualified for automatic extensions to their expired EADs if they file in time EAD renewal requests.
If the original form is current, employers may fill out Section 3 of the original I-9. If the original was an earlier version of the Form I-9 then the employer must either fill out Section 3 on the current version of the I-9 or fill out a new I-9 completely in the current version. In either of these scenarios the employer should add the new Form I-9 to the previous one.
If an employee gave a receipt for a document when completing the initial form I-9 in the first place, he/she is given 90 days to provide an employer the replacement document. In that time, the employer should use Section 3 on the current version of the I-9 form to change the information or draw a line along the old information (so that it remains usable) and then add the new information, then sign and initial the modification. If, during the 90-day window, the employee decides to submit another acceptable document that is different from the document the receipt was issued and the employer is required to complete Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of the reason in the box for additional information that is located on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that have green cards that are expired they were issued, should not be renewed. Green cards are proof of permanent residence within the United States, and they expire the same way as driver’s licenses do. But, the expiration date is not a sign that the holders have lost their right to work in the United States.
Employers may also amend Section 3 of Form I-9 if the employee’s name changes. However, it’s not required.
